Terms of Use

These terms govern your use of www.gammaworkshop.com (the “site”) and of the software applications published by Gamma Workshop LLC (the “applications”). By using the site or an application, you agree to them. If you do not agree, please do not use them.

Using the site

We grant you a personal, non-exclusive, revocable licence to view the site for your own information. You may not use it to break the law, attempt to gain unauthorised access to it or to any system connected to it, interfere with its operation, or retrieve it automatically at a rate that degrades it for anyone else.

Intellectual property

The site and the applications — including their text, images, logos, marks, layout, data and code — belong to Gamma Workshop LLC or to our licensors, and are protected by copyright, trade mark and other laws. The Gamma Workshop name and marks may not be used without our written permission. Nothing in these terms transfers any ownership to you; you get only the limited rights stated here.

Licence to use the applications

Applications are licensed, not sold. Subject to these terms and to any additional terms presented when you install one, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the application on devices you own or control, in the manner permitted by the rules of the store you obtained it from.

You may not:

• copy the application, except as the rules of the store you obtained it from expressly allow;
• rent, lease, lend, sell, redistribute or sublicense it;
• reverse engineer, decompile or disassemble it, or attempt to derive its source code, except to the extent applicable law expressly permits this despite the limitation;
• remove or alter any proprietary notice or attribution it carries;
• use it in violation of any applicable law, or to infringe the rights of anyone else.

Applications obtained from the Apple App Store

Where you obtained an application from Apple's App Store, the following also applies:

• This licence is between you and Gamma Workshop LLC only, and not with Apple. Gamma Workshop, not Apple, is solely responsible for the application and its content.
• Apple has no obligation to furnish any maintenance or support services for the application.
• If the application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the application.
• Gamma Workshop, not Apple, is responsible for addressing any claim by you or a third party relating to the application or your use of it, including product liability claims, any claim that the application fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
• Gamma Workshop, not Apple, is responsible for the investigation, defence, settlement and discharge of any third-party claim that the application or your possession and use of it infringes that third party's intellectual property rights.
• You represent that you are not located in a country subject to a United States Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any United States Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms, and upon your acceptance of them Apple has the right to enforce them against you as a third-party beneficiary.

Applications obtained from another store are subject to that store's terms in the same way.

Appropriate and lawful use

Some of our software presents information that people follow as a hobby, including publicly transmitted radio and public-safety communications. It is provided for general information and personal interest only.

• It is not an emergency service and is not a substitute for one. In an emergency, contact your local emergency number — 911 in the United States. Never rely on our software to summon help or to establish whether help is on its way.
• Information may be incomplete, delayed or wrong. We do not warrant that any data, feed, frequency, location or status shown is accurate, current, complete or available, and it must not be relied on for any safety-critical, operational, navigational, medical, legal, financial or commercial decision.
• Lawful use is your responsibility. Rules on receiving, recording, retransmitting, publishing or acting on radio communications vary between countries, states and localities, and include restrictions in some places on use in a motor vehicle or in the course of an offence. You are responsible for knowing and observing what applies where you are.
• Do not interfere with emergency response. You may not use our software to obstruct, impersonate, harass or interfere with emergency responders, public officials or anyone else, or to endanger any person.

Third-party services and content

The site and the applications may link to, or draw on, services and content operated by other people. We do not control those, we are not responsible for them, and a link is not an endorsement. Your use of a third-party service is governed by that party's own terms.

Purchases and refunds

Applications and any in-app purchases are sold through the store you obtained them from, and that store — not Gamma Workshop — is the merchant of record. Prices, taxes, billing, cancellation and refunds are handled under that store's policies, and refund requests should be made to it. Nothing here limits any statutory right of cancellation or refund you have as a consumer.

Changes

We may add, change or discontinue features, and we may stop publishing an application. We may also revise these terms; when we do, the date at the top changes, and continuing to use the site or an application after that means you accept the revision. Where a change is material we will make a reasonable effort to draw attention to it.

Disclaimer of warranties

To the fullest extent permitted by law, the site and the applications are provided “as is” and “as available”, without warranty of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that they will be uninterrupted, timely, secure or error-free, or that any defect will be corrected. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

Limitation of liability

To the fullest extent permitted by law, neither Gamma Workshop LLC nor its members, officers, employees or contractors will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or relating to the site or the applications, on any theory of liability, even if we have been advised of the possibility. Our total liability for all claims relating to the site or to an application will not exceed the greater of the amount you paid for that application in the twelve months before the claim arose, or twenty-five United States dollars.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

Indemnity

You agree to indemnify Gamma Workshop LLC against claims, damages, losses and reasonable legal costs arising from your misuse of the site or an application, your breach of these terms, or your violation of any law or of the rights of anyone else.

Termination

The licences granted here end automatically if you breach these terms, and we may suspend or withdraw access at any time. On termination you must stop using the applications and delete any copies you hold. The sections that by their nature should survive — intellectual property, disclaimers, limitation of liability, indemnity and governing law — survive termination.

Governing law

These terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-laws rules. The state and federal courts sitting in Norfolk, Virginia have exclusive jurisdiction over any dispute arising out of them, and you consent to that jurisdiction and venue. If you are a consumer resident in a jurisdiction whose law entitles you to bring proceedings locally or to the protection of its mandatory consumer rules, this clause does not take that away.

General

If any provision of these terms is held unenforceable, it is severed and the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign these terms; we may assign them as part of a transfer of the business. These terms, together with our Privacy Policy and any terms presented with a specific application, are the entire agreement between us about the site and the applications.
